Due Diligence
due dil.i.gence: the analytical process of the facts and circumstances associated with an investment, intended to provide an investor with a full disclosure of facts and risks in order to arrive at an investment decision.
In a best practice context, performing the necessary due diligence on any investment is both recommended and necessary. 1031 & TIC Investments, LLC and OMNI Brokerage, Inc., are committed to performing thorough due diligence on each prospective Tenant-in-Common (TIC) offering before it is presented for investor consideration. This due diligence, or the thorough analysis of property facts and risks, should be performed on every TIC offering before the decision is made to invest. Due to the timing restrictions involved with a 1031 exchange, investors are often rushed, thereby making it difficult to gather enough information to make a suitable replacement property decision. 1031 & TIC Investments, LLC and OMNI’s commitment is to review, analyze and identify premier TIC replacement property choices through a careful analysis and evaluation.
The due diligence at 1031 & TIC Investments, LLC and OMNI Brokerage, Inc. is at the core of the value proposition offered to clients. In order to give each potential offering the attention it needs, OMNI’s Due Diligence Department has full time Due Diligence Analysts whose sole responsibilities lie in reviewing each offering that is sold through OMNI and 1031 & TIC Investments, LLC. In addition to other criteria, these Due Diligence Analysts have identified the following five key areas of due diligence as their focus before replacement properties are selected and presented for investor consideration:
- Examination of the Real Estate Provider (Sponsor)
- Analysis of the Replacement Properties
- Analysis of the Market
- Analysis of Program Structure
- Evaluation of 1031 Tax Compliance
After a potential offering has been analyzed by OMNI’s Due Diligence Department, the assigned Due Diligence Analyst presents his or her findings to OMNI's Investment Committee, where it is again reviewed for potential approval. This Investment Committee is chaired by Jim Shaw and is staffed by the OMNI principals, as well as, other real estate and securities professionals. Each member of this committee has many years of commercial real estate experience and an aptitude for the 1031 exchange marketplace. Once an offering has gone through this examination by the Due Diligence Department and external parties, and is found to be a recommended offering, it may be approved by OMNI's Investment Committee and will then be presented for investor consideration by 1031 & TIC Investments LLC.
